Colin Mieling joined Bergman Draper Oslund in 2014. Since them, he has been actively involved in dozens of asbestos cases in both state and federal court fighting for asbestos victims. Colin works to make sure that those entities which harmed his clients are held to account. He is a tireless researcher that takes a particular interest in helping individuals who were exposed to asbestos in unconventional or seemingly unidentified ways. Colin also works extensively with Bergman Draper Oslund’s bankruptcy practice on the local and national level.
- Rublee v. Pfizer, Inc., No. 94732-5, 2018 WL 5732314 (Wash. Nov. 1, 2018) – Worked on a multi-year effort to develop the factual and legal foundation of an appeal that successfully argued that Washington State should adopt the apparent manufacturer doctrine as set forth in Restatement (Second) of Torts § 400. Reversing the trial court and Court of Appeals, the Washington State Supreme Court held that genuine issues of material fact existed as to whether a reasonable consumer could believe that Pfizer was a manufacturer of asbestos-containing Insulag and Panelag.
- Leren v. Kaiser Gypsum Co., Inc., No. 15-2-28006-6 SEA (King County 2017) – Developed the evidentiary record to demonstrate that Elementis Chemicals, Inc. is the successor to the Benson Chemical Corporation and liable for Benson Chemical’s distribution of Johns-Manville asbestos fibers in the Pacific Northwest. Served on the trial team which tried the case to a Plaintiffs’ verdict.
- Confidential – Conducted dozens of mediations and arbitrations with various bankruptcy trusts on a number of issues to ensure that our clients’ interests were represented to the fullest extent possible.
